Question: Divorce law? I am getting divorce from my husband. Because he wants to me to agree to have his freedom to have girlfriend and fear. He has bail bonding business which is corporation invested by one invester.
Should I see a lawyer or just go by NC law where I live?
Answer: You need to see a lawyer in the state in which the divorce
is being filed...OR in the state in which you reside...
Question: divorce law? a friend of mine is going through a divorce, she signed off the deed to her home to her soon to be ex. with the understanding he refinance and take her of the deed. he had four month to do so and home is still in both names.she has moved out four months ago.since then the house has burned down.she is still listed on the deed and the insurance policy. is she intitled to have of the money.
Answer: She is entitled to half of the money if he did not refinance before the house burned down. They have not divorced yet, nor did he have her removed from the deed. Half is hers.

Answer: Earlier this year, New York became the last state to allow no-fault divorces. Prior to this law, spouses who disagreed on the terms of a divorce couldn’t be divorced unless one spouse proved the other was guilty of cruelty, abandonment or adultery. With the passage of this law spouses will now be able to claim “Irretrievable Breakdown”; therefore, one spouse can cite irreconcilable differences in a divorce and the other does not even need to defend the charge. Therefore, getting a divorce will get easier in NYS, although its still recommended that your friend seek the advise of a lawyer. There is a great legal information website in New York, which has a list of legal aid offices in NYS, its called, www.lawhelp.org/ny and your friend can search under their Divorce section. Question: Does the Hindu Divorce Law have absolutely no respite for the helpless, battered husband of a faithless wife? I have consulted lawyers and found that the Hindu Divorce Law (very unlike the one for Muslims) has absolutely NO respite for the helpless and tortured husband of an adulterous/lawless wife in love with another who is most happy with the relationship only and not willing to marry her. In case the miserable husband is fortunate enough to be divorced by the wife herself, how long can the procedure take to come across?
Answer: Who was the foolish lawyer who told you that if a Hindu wife indulge in adultery her husband has no respite from her this act? The Hindu Marriage Act,1955 clearly provides:- Any marriage solemnized, whether before or after the commencement of the Act, may, on a petition presented by either the husband or the wife, be dissolved by a decree of divorce on the ground that the other party-
(i) has, after the solemnization of the marriage had voluntary sexual intercourse with any person other than his or her spouse;
If a Hindu wife has sexual relationship with another person then her husband & the husband has sufficient evidence to prove this sexual relationship/intercourse then the husband can get decree of divorce. The lawyer who told you that its only the wife who can give divorce not husband to the wrongdoer wife is either not a lawyer & has bogus law degrees. Always pay & consult right professional not the bogus one.
Question: Divorce law concerning children and live in boyfriend? I have been told that it is law in Mississippi that it has to be in the divorce papers that if you have children you can not have overnight guest that are not related while the children are in your custody.
Is this true?

Answer: Under the Constitution of Australia, marriage is one area which is handled by the Federal Govt, so it makes no difference which State you live in. The Federal courts - the Family Court and the Federal Magistrates Court - follow the same precedents nationwide.

Question: Do you think Hindu Divorce Law Amendment is constitutionally right? Religion is fundamental right of an individual which cannot be influenced or compelled even by close kin including spouse. The law including this clause in list of causes for divorce is against the fundamental rights.
Answer: Ever since the Constitution of India is made by the indian backstabber of Hindus, Dr.Baba Saheb Ambedkar, the chief architect of indian constitution, employed by the jawaharlal family, another backstabber family in india, indian constitution itself is unethical, since the said Dr, Baba Saheb Ambedkar hating Hindu system, converted himself and others to Budhism, with conditions like those who convert should not believe, LORD SHIV, VISHNU, BRAM etc etc.only to marry another, since Hindu custom did not allow second marriage while first wife is alive and there is no contemplation of a concept called 'divorce'.

As we know, the people in USA probably consume and send a highest amount of flowers, greeting cards for almost every occasions to each other. Answer: USA people are just to darn shallow, we are always looking at appearcance versus reality. yes flowers and crap appear charming but in the end is his personality worth marrying.
as yes she does have a perfect face and shape however when she is argumentative and hateful will the sex really matter. we are looking to fall "in love" but forget common sense such as COMPATABIILITY.

Question: If some states have a 50/50 divorce law then whats the use of a pre-nup? Like some states have divorce law that each partner gets 50% of everything. If so, then whats the use of a pre-nup? If they didn't do one then its 50/50? If they do sign one then its up to the pre-nup agreement reguardless of state 50/50 law?
Answer: The pre-nup takes precedence over the 50/50 law. The 50/50 law is applied when there is no other contract/agreement.
The reason for the law is because when you're married you become "one person" so to speak and with 50/50 both parties have an easier transition to life on their own.

Question: UNDER UK DIVORCE LAW assets considered for equal share? I separated from my husband 3 years ago and am now filing for a divorce under UK law. How are assets considered - is it the value they were 3 years ago at time of separation or is the value of these assets as they are now? The main assets in this case is the value of the house we shared which was valued at 240k pounds. It is now valued at 170k pounds.
Answer: I think it will maybe depend on who has been living and paying for the house since the split.
If you have been jointly paying for it then any loss or profit would be shared on todays price.
If only one of you has been paying it its only fair that the profit/loss seen in the three years goes to that person and the rest of the split 50/50

He got in trouble with the law, and lost his legal status in the U.S. and was deported back to his country. I am know tring to buy a house. the lender says i need to get a common law divorce.
Answer: Talk to an attorney. You must know if it is common law and, if so, what you have to do to end the proceeding.
It's worth 100 bucks to be sure that this guy doesn't show up in a couple of years and have a legal claim to half your house.

I am very confused with the tax advice I am receiving on divorce settlement money paid abroad. I am told that according to the new 2008 tax law, divorce settlement can be regarded as a debt and consequently taxed whereas it was clear that was not the case prior to this law. Also could gifts transfers from married partners prior to the divorce order be remitted tax free in the UK after the divorce order?

Answer: I dont know which 2008 law you are referring to, but I dont think its a UK one.
Divorce settlements have never been taxable in the UK and neither are other transfers between husband and wife. Nor is there a gift tax in the UK.

Answer: you can absolutely do that. focus on getting the best possible grades and LSAT scores, so as to get into a good law school.
go ahead and start trying to get internships in law firms or any public law office -- will help confirm what you want to do, and also help you get into law school.
Question: Who know's a little about divorce judgment inforcement law? My girlfriend's ex-husband will not comply with some of the items in their court-ordered judgment. She tried to be decent during the divorce but he refuses to accomidate in any way. Now she is afraid to get legal help to make him, even though she is do her share, and some involves the care of their children. She fears it will cost more to have the judgment inforced than what he owes her. Anyone have a little divorce law advice in CA? She really tried to be fair during a bad time and isn't trying to take more than what the court found to be equal. I'm just trying to help her feel a little better about the whole thing. Thanks.
Answer: I believe her legal issue is called "contempt of court", which means the judges decree has stipulated certain actions for both parties & one is not complying. Her only way to enforce the courts orders is to file contempt charges on him AND be sure to ask for court costs and attorney fees in the next judgement.
(I know...pay more NOW & go to court & hope to get this settled and RECOUP the filing fees!) Really unfair, since the innocent party must front the cost to seek justice against the violator.

Documents are from husband (or husband's attorney). Her English is not that great, plus she has no funds to hire a lawyer. I want to make sure she understands all of the terms of the documents.

Answer: Assets are usually divided equally.
BOTH parents have an obligation to support thier children financially.

In a divorce with admitted adultery, can the wife put a stipulation on the access of the father to the children as a result? Answer: I don't know about Canada, but it is automatically joint physical custody when you divorce in the US.
In that case she can't do spit, and no the court will not take the relationship into consideration.
It sounds like she is just being spiteful by using the child the way she is.

Answer: No, there is not such a thing anywhere. He will have to go to court to get a divorce. Even if his wife signed the divorce papers they would still have had to go to court to make it legal.
